By downloading, installing, or using the SafeCompanion mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and SafeCompanion ("Company," "we," "us," or "our").
SafeCompanion is a personal safety companion application that provides GPS-tracked safety sessions, distress alert functionality, emergency contact notification via SMS, area safety information, invitation-based meetups, and parental tracking features. The App is designed to supplement, not replace, emergency services such as 911.
You must be at least 13 years of age to use this App. If you are between 13 and 18 years of age, you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the App, you represent and warrant that you meet these eligibility requirements.
You must create an account to use the App. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
SafeCompanion offers a subscription service with a 3-day free trial period. After the trial period ends, you will be charged $9.99 per month unless you cancel before the trial expires. Subscriptions are billed through your Apple App Store or Google Play Store account and auto-renew unless cancelled at least 24 hours before the end of the current billing period. You may manage or cancel your subscription through your device's app store settings. No refunds will be provided for partial billing periods.
SAFECOMPANION IS NOT AN EMERGENCY SERVICE AND IS NOT A SUBSTITUTE FOR CALLING 911 OR YOUR LOCAL EMERGENCY SERVICES. The App is intended to provide an additional layer of personal safety awareness and contact notification. We do not guarantee that distress alerts will be delivered successfully, that emergency contacts will respond, or that the App will function without interruption. GPS accuracy, network availability, and device conditions may affect the App's performance. You should always call emergency services directly when in immediate danger.
The App requires access to your device's location services to function. By using the App, you consent to the collection and use of your location data as described in our Privacy Policy. You may disable location services at any time through your device settings, but doing so will prevent core App features from functioning.
The App sends SMS messages to your designated emergency contacts during distress alerts, session start notifications, and check-ins. By adding emergency contacts, you represent that you have obtained consent from those individuals to receive SMS messages on your behalf. Standard messaging rates may apply to recipients. We are not responsible for undelivered messages due to carrier issues, incorrect phone numbers, or network outages.
The parental tracking feature allows a parent or guardian to monitor a child's location during active safety sessions. By using this feature, you represent that you are the parent or legal guardian of the child being tracked, or that you have obtained proper consent. Misuse of the parental tracking feature to monitor individuals without their knowledge or consent is strictly prohibited and may violate applicable law.
You agree not to: (a) use the App for any unlawful purpose; (b) misuse the distress alert system by sending false alerts; (c) use the parental tracking or invitation features to stalk, harass, or monitor any person without their consent; (d) attempt to reverse engineer, decompile, or disassemble the App; (e) interfere with or disrupt the App's servers or networks; or (f) impersonate any person or entity.
All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, and software, are the exclusive property of SafeCompanion and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAFECOMPANION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, LOSS OF DATA, OR LOSS OF PROFITS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless SafeCompanion, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.
We reserve the right to modify these Terms at any time. Changes will be effective when posted within the App. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
